Flight cancelled, what are your rights?

Was your flight cancelled? If so, you may be entitled to compensation. According to Regulation 261/2004 and The Air Passenger Rights and Air Travel Organisers’ Licensing (Amendment) (EU Exit) Regulations 2019 your right to compensation for a flight cancellation depends on the moment you were informed about the flight cancellation:

  • If you were informed more than 2 weeks in advance, you are not entitled to compensation
  • If you were informed between 14 and 7 days before departure and you arrived more than 4 hours later, you are entitled to compensation
  • If you were informed 7 days or less before departure and you arrived more than 2 hours later, you are entitled to compensation

Note that you are only entitled to compensation if you were flying from an EU country, or if you were flying from outside of the EU to an EU country with a European airline or if you departed from an airport in the United Kingdom and the flight was operated by an UK airline. Your flight must meet these requirements in order to appeal to European Regulation 261/2004 or The Air Passenger Rights and Air Travel Organisers’ Licensing (Amendment) (EU Exit) Regulations 2019.

Extraordinary circumstances for flight cancellation

There are situations when you are not entitled to compensation for a cancelled flight. When the airline can show that they were not responsible for the flight cancellation we refer to this as an extraordinary circumstance. Such as flight cancellations due to weather, air traffic control strikes and acts of terrorism.

Example: You are informed about the cancellation of your flight four days before departure. Your replacement flight will depart on the same day as your original flight, but you arrive four hours later than your original departure time. In this situation, you are entitled to compensation.

If your cancelled flight falls under Regulation 261/2004 or The Air Passenger Rights and Air Travel Organisers’ Licensing (Amendment) (EU Exit) Regulations 2019, the amount of compensation is based on the distance of your flight.

  • €250 (£220) compensation for a cancelled flight up to 1500 km
  • €400 (£350) compensation for a cancelled flight between 1500 and 3500 km
  • €600 (£520) compensation for a cancelled flight exceeding 3500 km

If your flight exceeds 3,500 km and your arrival delay is between three and four hours, you are entitled to 50% of the compensation amount.
