Brexit: Has it changed the rules for UK passengers with a flight to or from Estonia?
Regulation 261/2004 was amended after Brexit to the The Air Passenger Rights and Air Travel Organisers’ Licensing (Amendment) (EU Exit) Regulations 2019 has been set in place to uphold your rights as airline passenger when you flight is cancelled. Both legislations protect your rights as an airline passenger and determines the obligations of the airline.
Your right to compensation when your flight to or from Estonia is cancelled
In order to qualify for cancelled flight compensation, you must meet the following requirements.
- You were informed between 14 and 7 days before departure and you arrived more than 4 hours later
- You were informed 7 days or less before departure and you arrived more than 2 hours later
You are not entitled to compensation if you were informed more than two weeks in advance.
Note that you are only entitled to compensation if you were flying from an EU country, or if you were flying from outside of the EU to an EU country with a European airline.
What if the airline can proof extraordinary circumstances?
If the airline can prove that there were ‘extraordinary circumstances’ and it was not responsible for the delay, you will not be entitled to compensation. Examples include bad weather conditions, terrorism, emergency landings and strikes.
Your right to compensation for your cancelled flight to or from Estonia
The amount of compensation is determined by the distance of your flight. This is divided in destinations within the EU and outside of the EU. Within the EU you are entitled to Regulation 261/set out the following amounts:
Within the EU:
- €250 compensation for a cancelled flight up to 1500 km
- €400 compensation for a cancelled flight between 1500 and 3500 km
For flight destinations outside the EU you are entitled to:
- €250 compensation for a cancelled flight up to 1500 km
- €400 compensation for a cancelled flight between 1500 and 3500 km
- €600 compensation for a flight exceeding 3500 km
